While the Second Amendment appears to give everyone the right to keep and bear arms, the United States Supreme Court has repeatedly recognized that this right is not unlimited. As a result, States may lawfully prohibit certain individuals from owning or possessing guns, such as persons convicted of felonies or certain violent crimes. But in Washington, if you’ve lost your legal right to own or possess firearms, you can file a petition to restore that right.

Determining whether you are legally eligible to restore your right to possess or own a gun can be complicated. Second amendment law is constantly evolving, both from new legislative changes made by our elected politicians, and from ongoing legal challenges in our State appellate courts and the United States Supreme Court. The current law for restoration in Washington State is set forth in RCW 9.41.041. As you can see, it is rather complicated. Plus, that law was enacted in 2023, and depending on when you lost your rights, it may or may not apply to you. Further more, there may be future legal challenges to the law that could change how courts interpret it.
